My long-running court case with Colin Webster has come to its conclusion and the end result is what I believe was an appalling decision by the judge to award Colin’s team costs even though virtually everything I posted in the original article has been proven to be fact. To draw a line under this sorry debacle this will hopefully be the last article relating to Mr Webster and his actions. The following section of this article is simply fact, followed by my personal requests to those involved.

The Facts

During the court case Colin Webster’s counsel admitted that yes, he is indeed the author behind the eSports Commentator blog, which is being written under the pseudonym Matatheni Mosotho. This confirms a number of points that I feel anyone who cares about eSports in South Africa as well as those associated with the MSSA should read.

Colin Webster also contacted numerous video game distributors and sponsors to state that all he ever asked from me was an apology and a retraction of the fraud charge. This is not correct either, as I offered a retraction and an apology in early March 2014, which can be confirmed by the court records of the case. Colin refused this and insisted that I never post the allegations of him being Matatheni Mosotho again and also asked for legal costs. I refused these requests and once again offered to post a retraction concerning the fraud allegation.

This was once again refused. I then published the apology and retraction of my own free will at which time Colin Webster’s legal team dropped their case on the merits, but went ahead in asking for costs. My apology was for getting a fact wrong about an unrelated case. I stand by my statement that this was entirely accidental and was not malicious.

My Personal Feelings and Requests

Why the judge decided to award Colin costs, and refused me permission to appeal, still baffles me –  but we move on. The costs will be covered by me personall:, the initial payment has been done by a concerned member of the public and a payment plan is in place to pay this off.

My final statements on this matter are that I formally request MWEB to rescind their sponsorship of the MSSA due to what I consider, in light of the above, to be Colin Webster’s less-than-honest dealings with the public and industry.

I also formally request the MSSA to expel Colin Webster from the organisation for life, for what I believe is his bringing the organisation into disrepute.

And finally I formally request SASCOC to remove the MSSA’s rights to award provincial colours in eSports as it has proven it is not handling this wonderful industry honestly and fairly. Again this is in my personal opinion.

I make these requests as a concerned member of the industry.

The eSports industry is exploding in South Africa and if we have any chance of being respected on the world stage we need to cast off the shackles of the MSSA and move forward with a clean and inclusive organisation at our side.

I will be posting one more article outlining the costs incurred, as I know it’s something many people are interested in, as well as how Lazygamer is going to be moving forward as an entity. This however is hopefully the very last article I am ever required to write about Colin Webster.

Because some people are more litigious than others, please refrain from using personal attacks.

            There has been legal precedent that if you are hosting a site/page/platform and people say stuff on it that can be interpreted as libel and you do not sensor/edit it in a “reasonable” time you can be held accountable. law != common sense

    Nasty business this was. Hopefully Gavin and staff laughs this off one day. My personal opinion remains that Gavin was sued for exposing the truth and how that leads to being dragged to court will forever remain a mystery to me. Here’s hoping justice or karma or maybe even some form of sanity prevails.

          It would have to be a bit more complex than that.
          Different judges would be vulnerable to different … “gifts”.
          Judge A would accept money while Judge B will only take rare wines.
          You would have to guess what to “gift” the judge to get the verdict you want.

          Of course there would be a random chance that the judge may not accept your “gift”.
          I will call it the conscience factor.

    If Mweb still sponsors/is associated with the MSSA then I will completely abandon Mweb. I will stop hosting with Mweb, I will stop using them as my ISP and I will make sure my company stops using Mweb altogether. The best way for consumers to speak is with their wallets.

    Dear Mweb, MSSA and SASCOC.

    What you need to all realize, and I believe at least Mweb does, is that us gamers aren’t children or idiots, and we won’t be satisfied if treated as such. By supporting the behaviour of Webster (not the little black dude, the large white dude pretending to be a adult black dude) you in effect condone his behaviour. I will not support a company or institution that does that, and I will voice my concerns to anyone that cares to listen.

    Mweb, although you can argue that you merely support SA e-sports, you CANNOT turn a blind eye to the true facts. You have the money, and thus power, to help change the e-sport scene for the better. Do the right thing, I implore you.

    Anyway, do as you see fit, but please remember that the internet never forgets.

    I still dont get it.
    they take you to court, over something that was both trivial, redacted and you publically apologised for, then they lose, drop the case, but you still have to pay colins lawyers fees?

    “appalling” doesnt seem to cover it.

    it was nothing but a scheme to bankrupt you, seeing as, regardless of the result, you were apparently going to end up paying their fees, with no chance of appeal or countering?
    am i the only one that smells white collar crime and fraud in the air? or was it just because I wasnt there and dont have the details?

    The whole case overshadows the conclusion.

      As this refers to the South African legal system and not Colin I won’t edit.

      I feel completely and utterly let down by the justice system which I felt let me, the media in general and the constitution of the country down. I was offered the chance to take it up with the constitutional court but since there was no actual legal ruling it was likely to fail.

        so they said you could come back, but there was no guarantee that you would gain anything by it, even if you were successfull, but then still end up having to pay their fees, again?

        admittedly, i have zero experience with law, I dont even watch TV crime/law dramas, but wouldnt your lawyer/team have something to say about that? someone to review the ruling?

        I feel like im going on a conspiracy theory rant, but the logic just doesnt seem sound and the ruling unfair.

            The judge ruled that I was the reason the entire thing was in court in the first place and that I dragged it out which is why he ruled on punitive costs.

            My legal team and I are off the opinion that is an incorrect ruling and goes against the facts of the case. BUT that isn’t a rule of law so it doesn’t matter.

            In a nutshell, do your very best to never ever ever go in front of a judge

            Again , this was “allegedly” brought out in court so therefor would be in the public domain.
            You have said it’s fact but you are not providing any proof that it is in fact fact.
            The court case was based arround ( and from the judgement record I read ) the claim you made that he had commited Fraud , so I dont see why his lawyers would even have discussed that point.

            It was raised in arguments around cost as his initial interdict was wide raging and not related solely to fraud at all.

            I don’t know what I am an aren’t allowed to post and to err on the side of caution I wont’ post any documents. The original interdict is in the public domain and available for viewing which shows it is far wider than the original fraud issue.

            AFAIK not everything stated in court is available online easily to see but the entire transcript can be requested if required. I am open to correction though

            You are able to transcribe the court record, but obviously there are costs involved as 3rd party companies must be used.

            Well obviously in won’t be in the judgment, because the court was not requested to rule thereon and only ruled on the issue of costs.

            And you don’t have to believe him. He has however done what is required in terms of law to acquaint him with the allegations and the correctness thereof. Colin has never denied that he posts as Matatheni and that in itself can be construed as an admission.

      I have to agree with you man, this whole thing got out of hand very quickly, to make matters worse, it’s like a bunch of monkeys slinging poop and missing each other to hit the surrounding public, yes there are issues, but handle them through the legal channels first, don’t publish articles and then when the fit hits the shan complain because, “I made a mistake in assuming a ferrets pee hole is bigger than its rear hole”…. Assumptions have caused many problems which we as a society could do without, it’s simple stop it….

      Hi. I am sort of a dis-interested party here.

      I do not always agree with Mr Mannions views, but would fight to the death for him to have them, as I would do the same for you or any other person. When views about other people are based on lies, as you have proven about the unrelated court case, that is not correct and an apology must be issued. This too was done.

      I feel I must ask, are the allegations against you true? Is this name a nick (word you used on article Gullivers Travels) – nic – for another person? I have no issue with Colin Webster, having never met or dealt with him. I do, however, have an issue with the fact that Mr Webster ran an organisation for years that, reportedly, clamped down hard on any form of “question” asking. You see, I do not know Mr Webster, but I know several people who personally have dealt with him in the games world, from inside of the organisation.
      I feel that activity goes against my principles of allowing different viewpoints and opinions. Transparency in management, by the way, has been proven to be far more effective than trying to control all around you.
      And I am anonymous here. I choose to be.

    Sorry to hear it Gavin. The MSSA in terms of the ideals and objectives it is trying to drive is definitely the way forward in terms of driving national teams. The reality however is that having national teams is currently not the manner in which the largest segments of the semi-professional / professional gaming scene work. It’s driven by private organisations who through competition draft and build their teams into the best outfits possible.       Honestly the saddest part of all of this is that I am in the minority of gamers who actually thinks the idea of the MSSA is a good one. Proper government support for our industry is excellent. It’s just a pity it has resulted in what we see before us

    I am part of a venue opening soon in Centurion Gauteng, we are aiming to take on the issues that is with the MSSA and other eSports bodies.

    We want to create an environment where qualifiers, finals etc will be played on an equal basis and with fair judging.

    Where every gamer feels they can fit in and live their dream to play the games they love and be awarded fairly.
    We will be hosting regular events, workshops.

    Streaming with commentators will be done on events being hosted at the venue. We are building our very own streaming booth. So if there are guys out there with a talent to commentate on games please inbox us.

    Again the aim of the venue is to start a new future for SA eSports.
