EA are going to visit Judge Judy’s friends soon because, well… because they were complete idiots at handling a mess that they already shouldn’t have gotten themselves into in the first place.

Battlefield 1943 was supposed to come free with Battlefield 3 on the Playstation 3. It didn’t… and EA seem to think that its no big deal, especially after they totally announced it to everyone on Twitter and everything.

Yep, its not only the case of EA not delivering on a promise that they made but also because it was only announced in a very shoddy manner on Twitter, so tons of people didn’t even know why the didn’t get the game they were promised.

What’s next, you open your case to find no disc and publishers are all like “Oh we knew we told you that you would be getting a game for full price but we actually only meant the box”.

The case is legit though and EA should not be allowed to just get away with something like this unchecked, especially when this could all be fixed by getting a system in place to give all PS3 BF3 owners a PSN code to simply redeem and download the game.

The suit claims that EA “misled and profited from thousands of their customers by making a promise that they could not, and never intended, to keep”. That is a little off if in my opinion, as I’m sure EA wouldn’t have made a promise like that had they known from the very beginning that they couldn’t keep it. The game is multi-platform so a sale is a sale is a sale (is a sale).

The report over on Kotaku has all of the details so you can check it out for more information.
