With tens of millions of dollars in the crowdfunding bank, Star Citizen was supposed to be the grand  spiritual successor to Wing Commander that fans had been patiently waiting years for. Instead, the current version of the game (and I use that term very loosely) is a collection of half-baked ideas and a benchmark for feature creep going too far.

Star Citizen today is no closer to realising its goals than it was five years ago, and that’s a shame for the people who provided the fiscal ground support for the project. Even worse, Star Citizen isn’t the game that many people backed, as its various modules have created something entirely different to what was originally envisioned and promised.

Take Ken Lord for instance, who backed the game to the tune of a staggering $4500. Lord had kept an eye on his investment, didn’t like how his contribution was being used and decided that enough was enough. Detailing how he attempted to get his money back, Lord explained that he first asked developer Roberts Space Industries for a refund and got denied the request due to it being way way past the 14-day limit on Kickstarter refunds.

Alright, fair enough. Lord then sent a letter to RSI, explaining that due to the fact that he lives with multiple sclerosis, he couldn’t play any parts of the game related to Squadron 42’S campaign, a first-person shooter module that had been added to the alpha build and is required to be played so that other content can be accessed. “My hands shake badly,” Lord said to Motherboard.

I have tremors… They just recently confirmed that you have to do the first-person shooter thing to get through Squadron 42. I can’t do that, I just can’t do that. So my money’s stuck in a game I can’t possibly play.

Any response would have been great, but Lord got met with a wall of silence as RSI decided to ignore him. What’s a fella to do? Lord decided to pursue the matter all the way to his small claims court, but his case was sadly thrown out as the court cited an arbitration clause in the game’s terms of service which was written specifically to protect RSI from litigation. Completely legal, unfortunately.

“If you and RSI are unable to resolve a Dispute through informal negotiations, either you or RSI may elect to have the Dispute (except those Disputes expressly excluded below) finally and exclusively resolved by binding arbitration. Any election to arbitrate by one party shall be final and binding on the other. YOU UNDERSTAND AND HEREBY AGREE THAT YOU HEREBY WAIVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL,” the clause cleverly read.

Here’s where things get tricky. That specific clause is a 2013 addition, and wasn’t present in the 2012 terms of service that Lord and many other players agreed to. Does Lord have a leg to stand on when his TOS included the following line?

These Terms of Service (TOS) do not affect any transactions made before its effective date. All prior transactions are governed by the TOS in effect on the date of such transactions.

Nope, because RSI managed to argue that the new clause could be applied to payments made before it existed. According to Kotaku, Lord made several pledges over several years, with the majority of those investments falling under the umbrella of the newer TOS. “His pledges with new money on top of his earlier pledges required him to accept the new Terms of Service,” RSI said to Kotaku.

Long story short, Lord got screwed and is now stuck with a game he can’t even play while RSI cunningly updates their terms of service to protect them from anyone demanding a refund as the game sinks deeper and deeper into development hell, as PC Gamer detailed over here. In many ways, Star Citizen has become the video game equivalent of Christian evangelism: It has a charismatic way of attracting converts, it has plenty of zealous followers and it’s possibly the biggest scam ever seen since a lightbulb went off in the mind of Charles Ponzi.

        Not sure if you use dwindling to say there are less backers today than a month ago… but technically the plaintiff is still a backer 🙂

        Flag it as scam until it is in Beta or even full release. You can even repeat it at each quarterly patch to be delivered. There is not a single comment section articles since 5 years without several shooting either scam, collapse, Ponzi scheme, vaporware, jpges… if not all at once:)

        That never stopped funding to grow from 12M$ to 190M$ and accounts from 100K to +2M so with quarterly patch releasing more gameplay, contents and performance improvement… I let you guess the inpact 🙂

        I sympathize toward anyone having a disease and this not an excuse toward your remark. I don’t care about what you can throw to me guy…

        I have disabled people in my company. People with handicap or disease want one thing before all: to be seen like normal human, because this is exactly what they are.

            Any TOS is subject to apply everywhere in full force (with variants depending on county law). That have nothing to do about any kind of honor or merit but precisely, to enforce to everyone what are the limit for all parties, I.E., a contract.

            CIG is faulty of one thing. Not have enforced their TOS before and let some think that whaever their actions, that will ends up with a refund.

            It is over and the message is crystal clear.

            Applied to 125 active accounts by Steam right now today. If you do not want to agree with TOS… don’t signed it! 🙂

            No need to reply to this Joe guy, he’s also posting on gamesindustry.biz, there he claims to be an employee of a Pakistani company, clearly this guy’s getting paid by CIG to appear everywhere and defend the game, says that the game is getting better with every patch, you must be blind to say that, still in 3.2.0 it runs at max 10-15 fps, after more than 6 years in development it says it all.

            Progress is measured in-game and not in YT-Vids, played 3.2.0 yesterday and it is not playable with a high-end PC, super low framerate and janky controls when flying a ship, nearly getting motion-sick. But keep on watching the vids, put on the rose-tinted glasses and believe what they tell you. I don’t care what they say or anybody, I go and play the game myself.
            Bottom line is that it’s a horrible experience. Period.

            It is +30fps for everyone now but you can’t get more than 10-15 fps… plus motion sickness. never thought aboutlooking for an exorcist? 🙂

            I got 30 with a 5 years old PC including GTX780 3GB. And it is in no way a released product with a year and half of optimization before probable Beta end of 2019.

            If you want to get fluid experience… go play a finished game. There are plenty around… still none of them approach SC scope. Period..

    Normally I’m all for refunds, especially if someone is in peril. But this douche bag does not deserve one.

          Give us the date and link where Chris stated that FPS gameplay would be a req of how a character mustered out of SQ42 then try to grok that we are 7 months into 2018 and no longer in 2014.
          Then show us a breakdown of precisely when each of these ’60’ exchanges took place, and what they were… ie: Ship purchases, CCU’s, subscription etc Joe.

    I really shouldnt’ because I know I won’t change anyones mind, haters being haters I guess, but still, I’m going to try to give my perspective.

    1. The guy pledges $4500 on a game. Let that sink in.
    2. Dog fighting is ok but first person shooting is impossible? Um…
    3. They put out quarterly patches with -a lot- of content, and while I do admit performance has been an issue, patch 3.2 is def. a step in the right direction.
    4. There’s, I don’t know what, 3 dev videos a week on their youtube channel showing what they’re working on. How transparent do they have to get to not get called scammers?

    Still, some people just love to hate the game, why? I’ve had a lot of fun with the current content and I’m looking forward to future content.

    Still not sure how some people can defend this game, the performance is abysmal and extremely bad!!!

    Seriously people, forget about what the article or I say, go and try out the game for yourself.
    Worst experience ever I have had in the last decade easily. Took me 20 minutes to get into the game!
    I have an i7 4790k, 24GB Ram, NV GTX970, fibreglass-highspeed-internet of the finest.
    Constant lags, fps drops, flight model was the jankiest flight model I have ever seen in any game.

    I am still amazed how you can defend this and say that massive updates and performance improvements are coming out, this is at best Pre-Alpha, doesn’t even deserve Alpha name.
    Btw, tested on 3.2.0, what a joke of a game.

      Nobody is swallowing your hate guy. Game is available for free by everyone several times per year. Unless using a 10 years old PC with 4 mg and a 3DFx GPU board, Nobody ever had to wait 20 minutes to get in game…

      I usea I5 x4cores + GTX 780 + 1440P monitor anf got consistent 30FPS in 3.2. No one on Reddit/SC valid your “experience”. Beside this gross obfuscation, if you can’t swallow bugs in Alpha… just wait for release… yes we know in 2050 or never 🙂 Try harder.

    Terms were pretty clear if you ask me… and why on earth they would donate that much and then take it back for a game that promises to be phenomenal I have no idea. SMH
