South Africa’s Constitutional Court has ruled that personal use of marijuana is not a criminal offence

In March last year, the Western Cape High Court ruled that personal use of marijuana (that’s Dagga to you and me) should be legal, declaring that bans on the usage of dagga by adults in private homes are unconstitutional. Today, the Constitutional Court has agreed, effectively making the personal possession, cultivation and use of cannabis at home legal – or at the very least, decriminalised.

It gives parliament just two years to change the laws regarding home use of marijuana. The ruling hasn’t however, said how much a person can legally have, and that will be up to parliament.

“The right to privacy is not confined to a home or private dwelling. It will not be a criminal offence for an adult person to use or be in possession of cannabis in private space,” deputy chief justice Raymond Zondo said in the ruling.

“This Court must invoke its powers under s 172 (1) (b) of the Constitution to order a suspension of the declaration of invalidity for a realistic period to ensure Parliament may correct the defect. In my view, a period of 24 months from the date of this judgment would be appropriate.

“The order also makes clear that the relevant provisions are only unconstitutional to the extent that they trench upon the private use and consumption of a quantity of cannabis for personal purposes, which the legislative considers does not constitute undue harm.”

The initial ruling by the Western Cape High court still left the legality of it in question, but this ruling now by the constitutional court makes it very clear that it’ll soon be perfectly legal to use marijuana at home.

And honestly? That’s a good thing. By decriminalising weed, it becomes possible for it to become completely legal – which could see job creation, taxation, regulation and other benefits.

    How this will affect South African society is yet to be seen. Those that use it carefully and wisely do not pose much of a threat, but considering the recent crime stats (murder, rape, abuse, assault, etc.), I fear we might see quite the jump in these figures within the next two years – especially as it relates to children! That’s what I fear the most!

    It is sometimes seen as a gateway drug. But really, the only reason it can be seen like that, is because many people need to see a dealer to get it, and then that dealer could lace it with something extra or try to push something harder on you. This way, I believe many will not fall for that kak anymore.

            Also depends on your tolerance level and your experience in handling it. And of course, the quality is also a big factor.
            Then there’s the different effects of the sativa vs the indica strains.

            I don’t smoke it, just use a bit of oil. After doing so, having a few beers (3-4) does make you “drunk” a lot quicker, in my experience anyway 😀

            My brother has also been smoking it for a number of years now, he suggested I try the oil as I have never smoked in my life (puffing a few times while drunk does not count) 😉 And yes, having Insomnia / difficulty with sleeping, it really is a winner.

            There are other way to “smoke” it. A vaporizer works very well. Cuts out all the “smoke”, so you just inhale the vapour. No lung damage, no sore throat, etc.

            There’s always the baking option, but (little known fact) eating it actually releases more of the paranoia inducing effect. And it lasts WAAAAAY longer.

            My brother in law smokes a joint before going out. He doesn’t buy any alcohol, and always gets the same, chilled, awesome effect that alcohol gives, and he can legally drive and do his thing without endangering anyone.

            Even with Uber I don’t really like it. If I’m out I rarely have more than 1 beer, and if I do it’s 2 max. Just don’t feel comfortable being drunk when I’m not at home.

          I’d say it’s safe to assume that more than 1 large plant, or maybe a few small ones is too much. If there’s enough to distribute, then it’s too much. We’ll see what parliament eventually decides though.

          If memory serves, from when I studied law in the late 90s, over 115g you are deemed a dealer or something. And the onus is then on you to prove you had that quantity for private use and not dealing.

      Agree! I don’t know SA’s record on this but I know the US is terrible in this regard. Perhaps a contentious issue but I still think drug use should be decriminalised. Not to encourage it but rather to aid rehabilitation. People using drugs (not selling) have an issue that needs to be addressed and fixed rather than punished. Just my 2 cents.

        The US is terrible in that regard. Their “war on drugs” has cost countless lives and ruined far more.
        The UK is also quite terrible. Marijuana is considered illegal there, no matter what reason you’re using it for. Their government stance is that it has no beneficial use at all, not even medical (despite a SHIT load of evidence).
        Yet they are the largest supplied of medical marijuana to Europe.

          There are various other factors involved, dammit!

            The seeds are very important. The guys who grow the really good stuff, they guard those with their lives. Even when you buy from them, they usually make VERY sure that there are no seeds in the product.
            The guys who sell jut just don’t care.

        Marijuana is a psychoactive drug: Def: a chemical substance that changes brain function and results in alterations in perception, mood, consciousness, cognition, or behavior. If we have so much rape, murder, abuse and assault in South Africa, often within the immediate family environment, how much more so could this become if people start consuming excessive quantities of marijuana, which by its very definition of being a psychoactive drug, alters ones mind. Personally, I will only feel comfortable about this decision when proper laws are instituted to try and limit abuse of the drug, albeit obviously, if the SAPS can actually enforce these laws, which is a debate for another day!

            Fair enough, but the argument is excessive consumption. People take anti-depressants and anti-anxiety medication which also affects their psychological capacity, but they are considered safe in correct dosages, and they haven’t lead to an increase in crimes obviously. Likewise, I am not debating that responsible consumption of marijuana will lead to problems. Excessive consumption could potentially lead to problems, aside from the obvious health risks associated with it, like nicotine.

            Anti-depressants and the like, those are synthetic drugs and very often they have terrible side effects. Getting OFF anti-depros is usually the most difficult part. They make people feel terrible.

            yeah gotta agree with heretic here. I know a fair amount of potheads and I’ve completely overdone it before but you can’t overdose on cannabis. People just get more chill, it’s nothing like any synthetic drugs.

            But the best way to convince you is let time pass by, you will be surprised at how much of what you think about it is complete garbage that was fed to us by the uneducated.

            Please note: I speak of excessive consumption. Has anybody ever wondered why so many countries still consider it an illegal substance. Even its medicinal qualities still require further testing according to research. Technically, it is no longer illegal to consume it in the privacy of your home with the judgement today, but just like with so many other illegal activities that became legal, society needs time to adjust to change, and time will tell how South Africa (which last year was in the bottom 20 of the most dangerous countries in the world – https://businesstech.co.za/news/lifestyle/200044/south-africa-ranks-among-the-most-dangerous-countries-in-the-world-and-its-costing-us/) will adjust to this change. I’m simply playing devil’s advocate here.

            I have my days, weekends, when I personally have consumed excessive quantities. Back in the days when I was still young and single and had no responsibilities.
            I’ve had gaming weekend with my friends when then was always, ALWAYS at least two joints being passed around. We smoked so much, Willie Nelson would have been proud. Snoop Dogg would have been awed.
            The only things were were violent against was food.

            I’ve known guys who have been hard, HARD smokers for years. In fact, there’s a guy I’ve known for more than a decade who and I don’t think I’ve ever seen him NOT high.

            No violence, dude. None.

            There are VARIOUS reasons why it is illegal in many countries. If you do just a little bit of research, you’ll discover that almost all those reasons are total bullshit.

          Did you know that humans have an endocannabinoid system? The cannabinoids in marijuana already exist in our bodies.
          In fact, they are actually PRODUCED by our bodies to relax us in times of stress.
          So, if you do go ahead and smoke a WHOLE LOT OF POT, you’re just going to get VERY relaxed.
          If someone goes out and commits violent crimes, they are NOT on marijuana.
