THQ sues Activision Blizzard Over Baja Box Art

THQ has filed a suit against Activision Blizzard because of similarities in the box art between the two games, of which THQ's has already been released for some time now. Both games are based around the same real world event, so you would think that a similar cover was like. One look at the comparison image though and you start to realise that it couldn't possibly have been coincidence that the artwork could be so similar, or could it? It seems to me like the cover art is nearly identical in terms of content and placement. THQ's suit says that Activision's "upcoming SCORE International Baja 1000 uses box art with artwork elements that are "virtually identical" to the former's packaging for Baja Edge of Control." Gamasutra reports that THQ have asked the courts to enjoin the game, saying the following: "If Activision is not enjoined from its impending release of the Activision Game bearing the [similar packaging art], THQ will suffer damages in an amount as yet unknown, but in excess of the jurisdictional minimum of this court and to be determined at trial," "THQ also would be entitled to Activision's profits from the sale of the Activision Game..." I fully agree. Activision Blizzard had already been contacted by THQ but then refused to change the artwork. If things go THQ's way, they could be looking to have a large sum of money paid to them in damages as well as as possibly taking certain profits from the sale of Activision Blizzards game.
