Yesterday morning I sent out a tweet asking if anyone knows of anyone who wants to buy the very best gaming website on the planet. Since then I’ve been inundated with people interested and even more so by people concerned about what is going on.

So here it is in a nutshell.

Earlier this year the General Secretary of the MSSA got angry that I posted a 99% factually correct article calling into question his ethics, behaviour and general ability to hold his position.

Instead of actually approaching the issue , Colin Webster decided to run to the courts and amazingly managed to get an interdict against me, even though the main thrust of his complaint had already been rectified on the site.

He then proceeded to be absolutely  by making  requests and refusing all fair and honest options to resolve the issue.

Eventually in July after he once again rejected a reasonable settlement, I posted a retraction of the accidental usage of the word fraud. His lawyers then dropped all other charges and all that was left was that the judge was required to decide on costs.

At this point I also offered to share costs on an equal basis, something which I thought was very fair since he was the one who went  to the courts and refused to accept any offers.

So it was with a fair amount of optimism that the courts would award costs against Colin for wasting their time.

It was not to be, the judge who I’ve been advised to not call names got this one  wrong. I personally don’t even think he  as he came to the conclusion that I purposefully delayed the court even though I had made two separate reasonable settlements.

Not only that but he decided I needed to be taught a lesson for doing my job properly and pointing out that Colin Webster has serious questions around his ability to run eSports in South Africa.

So the judge awarded punitive costs against me. I immediately said we should appeal but the law in South Africa requires you to ask the same judge who just  to agree he  before you can appeal. Which he obviously didn’t do.

I was then offered the chance to approach the Supreme Court of Appeal in Bloemfontein to ask their permission to appeal. However the SCA by rule will not hear an appeal on costs alone. Since Colin dropped his case (effectively) there was no rule of law to appeal on and as expected the SCA appeal was denied.

So now I owe costs. Colin’s first attempt at costs came to around R320 000. Once we had those fee’s checked it was ruled that they were basically inflating their costs by over R100 000. Which is a pretty  move but apparently perfectly legal.

Now with the appeals etc I am now left with a legal bill of around R250 000 along with an extra R30 000 that I still owe my lawyers.

Over the weekend I sat with my family and the owner of Lazygamer and looked at the best way to move forward. I could take that money out of the bond and carry on as before, just with an extra monthly bill around my families neck. But in all honesty the fact that gaming people are still supporting the MSSA, I’m looking at you Mweb as well as the gamers who will suckle at  just for bragging rights, has made me lose a little faith in the local industry.

Added to that I’ve been diagnosed with an auto-immune disease which, along with the long hours of gaming, is starting to affect my lifestyle. So maybe it’s time to move on.

With that in mind I’ve approached a few media organisations and private wealthy individuals to see if there is any interest to take over Lazygamer as a going concern after receiving approval from the silent owner.

The only way that I will be able to walk away from Lazygamer is if the new owners can give me assurances that my awesome team will be taken on and looked after. I couldn’t bear to see anyone ruin the site and I‘m definitely not just going to just sell to the highest bidder.

In fact I may not sell at all. I’ve also been approached by some of the community with the idea of opening an investor pool of sorts for the community to pitch in and become part owners of the company. Whether this is a real possibility or not remains to be seen.

And in the end I may just pay the bill and carry on as before. Obviously it’s a very emotional time right now and I’m just looking at all my options.

So that’s it, if I missed anything or you want to know more info let me know in the comments and I’ll do my very best to answer all of them.

If you feel the need to vent at Colin Webster in the comments please remember he’s a  who runs to the courts whenever possible so make sure you phrase your comment so it’s obvious that it is your personal opinion else I may have to remove the comments before his  lawyer sends me more love letters.

I think that’s it… oh and yes I am legally allowed to post the articles I was forced to remove again. I’m just adding more details and facts to them and then will be asking Colin, the puppet MSSA president, the IeSF and Mweb for official comments.

Stay tuned for that, it should be fun. I’ll ensure I finish what I started before moving on. Oh and I’m not allowed to use the MSSA logo without fear of yet another legal letter, so I made a representation of it which I’m quite proud of.

    Hope you get to grips with your disease diagnosis. I cannot even imagine the pressure it puts you under, work a high level job, gaming website, courtroom duties and now a new, potentially lifestyle changing disease too.

          Admiral, you should just make them a deal they simply cannot accept. For instance, tell them you’ll move lines and accounts to them if they give you an uncapped, unshaped account at 10mbs for R500 per month. If they decline you can simply say “then call me when you can actually help me” and if they accept…they won’t accept so don’t worry 🙂

          I always take the easy way out. Tell them I’m busy working & to phone me at 5pm. Usually they don’t because it’s after their working hours, and if they do I’m usually at the gym at that time without my phone. Win.

      Hah. I was by Mweb, then tried to leave because I was throttled 24/7. They said, “fill in an application to cancel services”. You think that application exists anywhere on their site? Hell no.
      So I made a rather comprehensive one myself, sent it and posted it on Hellopeter for good measure.

      I do not agree with some of what Gavin or other people say, but I will defend their rights, within certain very, admittedly, complex conditions (Freedom of speech, balanced against rights of others vs rights of society), to say it.

          Well, that is partially true. But I have been reading newspapers (paper ones) for many years and one of the exciting parts for me was always the opinions pieces. There would be an editorial piece, where the editor in chief (or similar) would spout his / her opinion about something or other. Quite often a guest writer, like a professor or something would also contribute an opinion piece. Pretoria News typically had one or two per evening edition (many, many years ago, I no longer read paper media, other than my books)

          Prof Jansen writes opinion pieces for newspapers that get nationwide publicity, for example.

          I think this is the same thing, just on a much, much smaller scale.

            Very true but opinionated pieces are alwyas clearly marked as such in the same way full disclosure should be had on paid or promotional pieces. its a tricky fine line where the use of one word or the neglect to use one another can cause a site serious damage

    Just a question, do you get some kind of insurance that covers your legal fees if you get taken to court for something you said? I know I’ve got some kind of clause for personal liability in my insurance contract. Or is that for something else

        According to old mutual website:
        iWYZE Personal Liability insurance cover will protect you against claims made against you by third parties. There are various types of cover available, including Property Owner’s Liability Cover, Extended Liability cover and even Legal Insurance to cover your legal costs.

        According to me that should cover all legal costs?

          yea that might be, BUT read carefully into that type of thing. They will not cover you for certain events, which they call relief or excusable events or force majeure events. I haven’t read their policy, but it might well be they cover you up to a certain limit for anything.

            Just read a little bit further and found this:

            iWYZE will cover your legal costs in the event of:

            A civil action brought by or against you.
            Your defence against any criminal charges brought against you.

            We will also arrange for representation on your behalf at any inquest (e.g. at a post mortem) in terms of applicable legislation, where the circumstances of death are unclear or questionable.

            This seems like it would have covered at least a part (if not all) of the legal costs.

    You know what, my day is ruined. All Gavin did was tell the truth and he got nailed for it. He did a report on MSSA and pointed out what was wrong with the organization as a whole and as a result stands to lose everything he worked his ass off for. I wish no person ill but there’s a few on my list now that I wouldn’t piss on if they were on fire.

    I wouldn’t pay his costs. I’d ignore his lawyer’s letters. But I’d do a transfer for R10 or something pathetic once a month so I could show I was trying. You have a family to feed and you’ve made a concerted “effort” to pay him. So no one can throw you in jail.

    I’m not really a “gamer” (I prefer the term button basher) but my brother is and at every competitive LAN I’ve been to if you mention this man’s name or the MSSA it is responded to unfavourably and with a host of colourful swearwords. IN MY PERSONAL OPINION he is a wanker.

    If you set up a donation fund I shall be giving YOU AND LAZYGAMER money Gav.

      That’s what someone I used to work with did. He had accounts everywhere, couldn’t afford to pay them back in full each month, so paid a tiny bit & when they phoned to demand payment told them he’d paid all he could afford. They couldn’t do much about it.

    If I had the money to invest I would. Love the gaming industry and what it gives us gamers: A release/ escape from that brief moment in reality and allow us to do things we could only dream of.
    You guys have done a brilliant job on keeping us South Africans up to date and this site is on par with the other sites out there. I was introduced to this site by a friend and from there it has been the go to place for the local point of view.
    Gavin: yourself and Guild made me feel right at home the first time I loaded the Destiny beta. I felt like I was part of something fun and fuzzy/new.

        I fully agree. my biggest problem is that social media has turned society into these self opinionated assholes. Suddenly everybody is a victim and nobody takes responsibility and rant like 5 year olds when they don’t get their way. What I have seen on a lot of sites is a bunch of grown men fighting over:”who has the best toy”, “why can’t I get what I want” and “he is bullying me waaaaaa!!” How old are you that you can’t move past these these life lessons given to you +-20 years ago ? I have fallen for this behaviour myself sometimes and then just realise: Hell i am older and wiser enough to not let this get on board and waste my energy.

    I kind of hope you stay on Gavin. Lagz is honestly the only gaming site worth viewing, and with all due respect to Geoff, Brenda, Zoe and the rest of the crew (who are they again?) this site would not be the same without an article here or there that does not feature that grumpy guy in the avatar that has NEVER changed since I discovered this site.
    With that said, your health and family SHOULD come first.
    And to Colin Webster: Sir, I kind of hope you realize that what you have done has honestly hurt the local gaming scene more than it did it any good.
    There were a bucketload of other options available to you, other than running to the courts. Would it not have served our local scene better had you simply taken to an open and honest discussion with Gavin and Lagz?

        Gavin, just a word of advice. Keep your side clean. IF you don’t make any negative comments about Colin Webster, he would then have to issue summons against each and every person that had made a negative comment, then get court dates, summon out of the relevant jurisdiction etc etc. So, keep the moral high ground, and once in the media, always in the media. People do tend to trip themselves when digging a hole for another. Seen it happen many many times!

I understand the issues involved and the possibility of additional costs (Legal and other) in doing this. But I would be willling to buy into this site as I think it will only get bigger and better.

      I do my best to read all the comments on my article and respond when asked.. don’t always get it right.

      As Guild mentioned below we are looking into the possibility as well. The current owner was looking at transferring the company to myself in 2015 anyway as they don’t have time to deal with dickheads with ego complexes.

      If the community owning the site becomes a viable option we will definitely be posting about it. There is a lot I need to make sure it legal and viable though.

    This is why I stay away from SA gaming entities and the larger community in general. The filthy bureaucracy and bullying involved is just too much.

    To those who make said entities so horrible, all I have to say is : Congrats! You are slowing but surely destroying the E-Sports community in South Africa. Hope you are proud.

      This site has always embraced the writers personal opinions.

      I’m not looking for anyone to feel abd for me and I’m an adult and can accept the decision, even if it is absolute bullshit and a disgrace of a ruling.. in my opinion

      I just wanted to clarify to the community what is currently happening.

      My original post about Colin Webster was entirely professional, I made one tiny factual error and he jumped on it as if it was a fresh donut. The factual error was resolved long before he approached the court.

      I would say he made this personal but as I said, I’m an adult and will deal with this in a mature manner. With lots of alcohol and petulant insults.

          Not sure how, but I most certainly have noticed posts vanishing and then re-appearing on a refresh. How much time to a refresh, I was not sure.

    Truly good folk will always be the ones to bear the brunt of injustice, the first ones to weather storms of moral obligation.

    Don’t mean to sound cheesy, generally can’t express melancholy very well. In my opinion you don’t blow things out of proportion like that if you have nothing to hide.This all sounds grossly unfair and extremely challenging for you and everyone involved.

    I’ve also suffered a a rather serious physical setback (if we can call them that) so I just wanted you to know that all of this really resonates with me. If not in similarity then most definitely in the parallels of struggle and hardship.

    I disagree with the idea of you stepping down as I honestly think you’re the best kind of ‘leader’ for this site… a reluctant but honest hero makes for a very effective one.

    Whatever you guys decide, we’ll obviously all support the decision. With you 100%.

      Let’s Ben every clear here. I never once accused Colin of fraud. I misinterpreted the case as being a case of fraud as I’m not a legal person.

      As soon as I was notified that this wasn’t a court case I updated the article.

      But your now that and are just trolling.

      The court docs are public domain any layman can read them and see that the entire case was an attempt to hide the real truth.

      Which will be published shortly, since they truth is now also public domain

            Everyone is biased. You , me, everyone here. The interdict would not have been granted unless the court felt Colin had a case. And everything in the transscripts bears that out.
            Go read your 1st article again , you will see you went a bit further than merely “Describing” a court case.

            Actually no, interdicts get granted all the time on flimsy evidence and half truths. The most recent being Chester Missing…

            Also my interdict was dropped and I was granted full permission to repost the whole article except the one special word. Which really does prove that the interdict should never have been granted in the first place.

            I’ve read that first article a million times. I stand by it and it has been passed by lawyers and the legal system as fair comment.

            With the way Gavin approached this whole saga I feel he is lucky to get away with only R250K in school fee’s. It could have been a lot worse.
            Freedom of speech only gives you so many rights and other affected people always have the right to a court of law.
