Microsoft’s appstore a clone haven?

Last year, there was a mini furore about the rather lax restrictions in place on Microsoft’s Windows 8 PC and phone appstore; specifically those regarding the illegal use of materials and clones of other games. Still available to download are a number of games bearing classic Nintendo characters, like Mario Jump!, Bowser Town Defense, Pokemon Attack! and Yoshijump.

Back then, Microsoft pledged to take app store piracy very, very seriously indeed – though also highlighted that it’s not their job to sift through apps to find illegally used artwork or ideas.

With regards to trademark infringement, with every app there is an option to report the app for violating the Windows Store’s Terms of Use. If a company feels a Windows Store app is infringing on their copyrights or trademarks, they should report the app and we will take immediate action to determine if the app should be removed from the Windows Store.

Apple’s Appstore tries its best in stopping this sort of nonsense, even though a number of games have slipped through the cracks – including a Desktop Dungeons clone. It seems though that Microsoft hasn’t really taken this copyright infringement business to heart. Braid creator Jonathan Blow has been tweeting about a number of games on the Windows Store that use assets from his time-bending game.

One such gem is a Doodle Jump clone using Braid assets, called Breid. Not very clever, really.

It’s not the only one.

Of course, there are many who believe Braid itself is little more than a Mario clone – which is exactly what Gavin thought until I forced him to play it right through to the end. Pretty much at knifepoint. Yes, though it may use many elements and even imagery from Mario, it’s all homage, and Braid stands on its own.

Even if it is indie hipster twaddle.
