Our legal woes continue and it’s costing a fortune

As our regular readers are well aware I am currently in legal wrangling with the ex-President and current General Secretary of the MSSA, Colin Webster.

Unfortunately since the case is currently on going which means I can’t talk that much about it. But to put it in simple terms Mr Webster took offence to something that I posted on this website and has taken his complaints to the High Court in Pretoria. The very same court Oscar Pistorious is currently facing murder charges in.

Seems excessive to me but hey the legal system is a complicated beast and this is where we are.

I’m currently being represented by the great team at Webber Wentzel who are specialists in these matters and we’ve made, what I felt was a fair, settlement offer but this was rejected and I in turn rejected the requested settlement discussions from Mr Webster.

What this means is that we need a judge to decide and now we are effectively doomed to litigation which is a horrifically expensive and painful experience.

The last time I requested help with the legal funds you guys and girls were incredible and raised an incredible R23 800 which blew me away. Added to the R20 000 I have thrown in already and we now have a legal fund of R43 800 which I was sure would be more than enough.

I was wrong. The legal team has quoted an estimated cost of R60 000 which is including a 15% discount as they feel this is an important case to fight.

But that cost also excludes the Advocate and since you require an Advocate to enter the High Court we have been quoted an extra R40 000 for a day and a half. Yeah we’re all in the wrong industry aren’t we.

Thankfully we seem to be confirming an Advocate at around half that price but it still means I’m around R35 000 down.

So I again turn to the community and ask that if you are able to help out in any way and feel this fight is worth fighting then I would be most humbled if you could send your donations into my dedicated legal fund account.

    Quick question: Is Mr Webster so rich that he can afford to stay in litigation/court for so long, or is he getting his legal fund from a more public (government?) fund?

      I don’t know the answer to that.. there are theories that his friends are doing most of it for free or that he writes all his own legal documents and just gets a lawyer to stamp it off… but I really don’t know

    Thought R40k wasn’t enough. My last legal bill (no civil or legal action etc just something that has to be handled by lawyers as prescribed by law) was R100k, the original qoute was R60k.

    One of the biggest firms in South Africa and I had to do all the work because they are stupid to get anything done since they use “clerks” they pay R5000 a month to attempt to do the actual work. Even had to fix two errors in the invoice because they can not perform basic addition.

      Lawyers are also subject to the consumer protection act, so if you are not happy with the services, bring it to their attention and demand refunds. I did that before when I found the lawyers incompetent and they would rather give me a massive discount than face the disgrace of going to court over bad ethical practices…. I didn’t need a lawyer to do this – but its important that you do know a little bit of the law.

    Sorry Gav, this time round I have no cash to support. Just spent R5k this morning on fixing my car 🙁 I am flat out broke!

    I’m really upset that he refuses to settle out of court. I wonder if he realises he is hurting more than just you? What about your staff, your family? What is his purpose? To bring you to ruin while bringing all those around you to ruin as well? Just coz he is upset that you said some things about him? Is he really the kind to destroy multiple lives in the name of revenge?

    This really pisses me off!

    Colin, if you are reading this, please just stop! You are not just going to ruin Gavin, but everyone else around him. Just think about that. Do you really need or want that on your conscious?

        I hope that somewhere along the lines something clicks and he realises he isn’t going to get much out of this.

        If you are found completely innocent, how much does he have to cover again? I remember you saying you can’t even claim the full amount back that you had to spend on protection?

          On average arund 33% of costs are returned if they rule that he will need to cover costs.. which is about R40 000 in total

            Any money left over will be offered back to the people who donated it as a percentage of what was donated.

            We also have a plan to help eSports in SA that will be revealed after the case is over.

            The site we are selling from is actually owned by us so I just need to get some stuff up there

        It is one of those industries that can do with some regulation.

        If a lawyers clerk phones you you get charge anything from R50 to R300 even if they only get your voicemail.

          I know, some exp with it. Labour lawyers, R800 for a letter to my employer. R600 for the 20 minutes to meet with them to describe the need. But I paid for the knowledge, the guy gave a canned letter, written long ago, but he put years of work experience and knowledge in, so I was happy.

          The housing stuff annoys me. I phone the legal council for this area (I kid not) and asked about the bill the banks (they told me it was my lawyer, but they instructed and I paid) lawyer for the house bond a few years back.

          My lawyer charged the maximum agreed upon fee for EVERY single item. R500 for posting a letter, for example. I was not happy.

          I know an advocate, does very well for himself. And he told my how much he charges for various services. Not near what was quoted here!

          It is regulated, the problem is it is regulated by the same attorneys that you’re trying to fight. You can go the route of asking the court to tax the invoice but there is a problem with that as well. The court adds 5% to the invoice just for the attorney to draw up the invoice. If the court taxes the invoice and the cost isn’t less than 10% of the fee asked by the attorney then they award another 5% to the attorney. In other words you can end up paying more for the services rendered after the taxing than before. It also takes months for this to happen and the attorneys knows it. That’s why they ask whatever they want to ask because they’ve made certain that their backsides are well and truly covered.

      Hi Andrew. I asked my legal team before posting these sorts of articles and they have no issue with them.

      I see this as using the very platform my team and I have built from nothing to protect the platform.

      My only issue with Mr Webster’s actions is that I have not yet been given a chance to put my case to a judge. Which will be recitified on Tuesday

            See attached screen shot I took… Both comments were made under Sandelk. After I refreshed some of the posts made by Sandelk either turned to Andy or Riaan, or stayed Sandelk.

            That is what caused the confusion. And I did apologies if I am wrong in any way. but it did seem suspicious and like some one is just trolling for attention.

    My advice to you guys is try and settle rather than keep this nonsense going. Mr Webster is going to draw this out as long as possible especially after seeing these types of articles and at the end of it the only winner will be the lawyers.

    Use it don’t use it, but sadly your costs will more than likely go well above R100k if you keep trying to fight this.

      From what I’ve seen and heard from Gavin himself is that they tried to settle out of court, but Mr Webster rejected the offer, so hopefully a settlement can be agreed on in court, and Mr Webster is half reasonable.

      Just to clarify the legal action is not around harrassment at all. The previous articles regarding what I felt were the misguided actons of the MSSA were done because I felt the MSSA was ether bullying eSports teams or holding unofficial test matches and selling them to sponsors as official.

      I have a ton of shame and it hurts me more than anything to ask the community for help but I feel we have been unfairly targetted in legal action and I have to try and save the site and my family.

      I’m well aware that my form of reporting doesn’t sit well with everyone and that is perfectly fine. However having my freedom curtailed is something very serious.

    Please understand Gavin that I take no pleasure in this as I have legal experience and understand what its like to be involved in these situations.

    There is no schadenfreude, merely irritation at the fact that you don`t seem to grasp that these are the consequences of your actions, and by expecting the public to pay for your mistakes, you are not taking responsibility.

    And yes I am taking the time to argue something on the internet (what have I become) simply because I do not view this as a righteous cause and it grinds me because I have legitimate legal problems not of my own making which I cannot get solved because of the costs involved, so I become bitter when you take to a public platform to ask for money for overpriced lawyers to defend something that could have been solved by simply being mature, taking the high road ( the best road ) and apologising.

    I have said what I came here to say and do not wish to engage in internet flame wars.

    But ffs guard your tongue and think about consequences before you shoot of at the mouth. Be professional.

    By the way have you thought about perhaps issuing a public apology to MR Webster and the MSSA, they might not accept it, but courts love contrition and it would definitely count in your favour.

      An apology was not accepted, I really didn’t want it to go like this and yes I could have hired cheaper lawyers. However I believe strongly that you should always get the very best service when you require something.

      Asking the community is my way of not selling my car to pay for this but that is still an option I will do to ensure we are not oppressed.

      As for it not taking any toll on me, that is unfortunately not true. My wife is rightly more than pissed at me and this law suit is causing a huge strain on our relationship.

      Lazygamer started as my personal hobby and I still have a full time job that I use to support the site. Now the hobby could result in us losing a car and possibly more. Trust me I’m feeling the pain.

        I am sorry that this is having a negative effect on your personal life but keep hope that this will not be permanent.

        As someone with a law degree and exposure to the legal field I can honestly say that the best advice anyone can give you is to stay as far away from lawyers and courts as possible. Lawyers do not act in your interest as it is in their interest to drag the matter out so they can continue to charge you.

        I am sorry I called you pathetic by the way (emotions) i could have chosen a better word to portray my feelings, unbecoming of a professional organization would have worked better.

        I sincerely hope that you do not suffer too much financially and emotionally and that you can continue to pursue your passion and hobby.

        Perhaps just pursue the MSSA less passionately.

      Yeah, it’s not like hindsight is 20/20. It’s true that you are entitled to your opinion, something however that is diminished, in my opinion, by your comment(s) and name calling (blah blah blah shoot of at the mouth. Be professional) – hypocrite much – I think somewhere you use the word “pathetic”.

      Yes, I do like the LG site and I think their passion is what makes the site.

      But for me the bigger issue is should LG be ‘gagged’ for expressing their opinion? One that whilst being “sub judice” is debatable as to it’s legality – they are entitled too it. And Colin, in his role as a public figure, surely allows greater scrutiny than a private individual (look at the judges ruling of the so called “trial of the century” Pistorius (spelling) trial.

      And I find it fundamentally reprehensible that purely from a lack of funds someone can lose a legal case or be frightened to stand up to someone/organisation – I fully understand the realities of life, money will usually win out. But I am happy to do what little I can to stand up for what I think is right.

      I feel for you with your current legal worries and I wish you the best of luck in an expedient and favourable outcome.

      And to LG, let me know at the end of the month and I am happy to help out again.
